Most of our clients operate websites or post content online. To what extent are they liable for publishing infringing content on the Internet? Over the past few years, courts have found service providers not liable for user-generated content. In UMG Recordings, Inc. v. Veoh Networks, Inc., 665 F. Supp. 2d 1099 (C.D. Cal. 2009), the Court held that Veoh, an online video service similar to YouTube, qualifies for the Digital Millennium Copyright Act safe harbor protection because Veoh made a good faith effort to avoid storing infringing content and Veoh had no actual knowledge of infringing content.
